Experience

Arshiya is an Associate, resident in the New York office. She is an experienced litigation and trial attorney with a practice focused on high-stakes commercial litigation, employment disputes and international arbitration. Arshiya handles complex business and employment disputes for clients in state and federal courts, as well as in other alternative dispute resolution forums.

Previously, Arshiya practiced in India, where her commercial litigation practice involved representing federal agencies and Indian corporations in high-value disputes before Indian courts and arbitral tribunals. She provided counsel in matters involving business disputes, including contract, fraud, insolvency and bankruptcy, and insurance. She also worked with the capital markets practice of a leading Indian law firm where she advised on cross-border securities offerings.

Prior to Windels Marx, Arshiya practiced at a boutique litigation law firm in New York. Prior to that, she clerked for the Honorable Andrea Masley, J.S.C. at the New York State Supreme Court (Civil Branch, Commercial Division), where she gained substantial exposure to New York Commercial Division practice.

Representative Matters

Prior to Windels Marx, Arshiya was a member of the trial and arbitration teams (both in the U.S. and in India) on the following matters of note:

  • Represented a senior executive in the luxury construction industry in New York Supreme Court and the Appellate Division, First Department, defeating enforcement of a three-year non-compete and securing vacatur of a preliminary injunction that barred competition.
  • Represented an Indian multinational conglomerate in Singapore International Arbitration Centre proceedings against an American multinational technology company in connection with disputes pertaining to breaches of Share Subscription and Purchase Agreements.
  • Won advancement of litigation costs for a terminated CEO in Delaware Chancery Court’s first ever magistrate-handled advancement proceeding.
  • Represented the Indian airports regulator in arbitration proceedings in connection with a $2 billion dispute pertaining to breaches of Airport Concession Agreements for the New Delhi and Mumbai airports.
  • Represented an Indian retail company before the Supreme Court of India in proceedings challenging the enforcement of an arbitral award.
  • Represented a leading Indian telecommunications company in bankruptcy proceedings before the Indian bankruptcy tribunal.
