Scott Matthews, John Keneally Win Dismissal of $1 Million Transfer Tax Challenge
Litigators Scott Matthews and John Keneally, teaming with Real Estate Partner Mitch Gilbert, successfully won dismissal of a qui tam action filed ostensibly on behalf of the State of New York against a NYC real estate developer and hotel operator and its beneficial owner. The plaintiff alleged that our clients had failed to pay transfer taxes of at least $1 million, plus fees and penalties, with respect to its purchase of its partner’s ownership interest in the development of a New York City hotel. The Supreme Court, NY County, issued the Order dismissing the Complaint, ruling that our clients did not own more than 50% ownership interest, which is the threshold for transfer tax applicability.
