Experience

Ben focuses on all aspects of complex corporate and commercial litigation. He has actively represented clients in state and federal courts and in alternative dispute resolution forums. His practice has focused on commercial, corporate, and contractual law, real estate litigation, UCC transactions, securities, and creditors’ rights proceedings. Ben's background has easily translated to other commercial concerns including high net worth and estate matters and corporate real estate transactions. 

Representative Matters of Note
  • At a prior law firm, Ben was a member of the legal team that successfully represented a developer in connection with a New York Real Property Law 881 dispute that arose on its Tribeca project. The dispute involved the owner of the adjacent property who: alleged that the developer caused damage to its building during the course of construction; denied access to complete the work; further alleged that the developer sought to install underground bracing that was a “permanent intrusion"; and repeatedly denied access until the developer paid exhorbitant monetary damages. The Court rejected the neighboring property owner's arguments -- going so far as to call them “dubious” -- and granted the developer access for 24 months, in addition to ordering that they only pay the neighboring property owner’s legal fees plus a small access fee, which the firm offered to pay in its motion papers. 

Prior to joining Windels Marx, he practiced at several prominent boutique law firms..

During law school, Ben was Associate Notes and Articles Editor of the New York Litigator Law Journal.  Previously, he served as Deputy Village Attorney (Prosecutor) for the Village of Valley Stream.
